About these Terms

These Terms of Service ("Terms") govern your use of BookingsXP: the website at https://bookingsxp.com, the dashboard, the booking widget and its embeds, packages and WordPress plugin, the hosted booking pages, webhooks and the REST API (together, the "Service"). "We", "us" and "BookingsXP" mean the provider of the Service, registered in India. "You" means the person or organisation that creates an account.

By creating an account or using the Service, you agree to these Terms. If you accept them for an organisation, you confirm that you are authorised to bind it, and "you" means that organisation. These Terms form the agreement between you and BookingsXP.

1. What the Service is

BookingsXP complements Microsoft Bookings. It does not replace it.

  • You connect a widget by pasting the public link to your Microsoft Bookings page. BookingsXP reads that page the way a visitor's browser does and creates bookings through it. It needs no Microsoft sign-in, admin consent or Microsoft Graph permissions, and it has no access to your Microsoft 365 tenant.
  • Microsoft Bookings remains the system of record. Bookings are created there, appear in Outlook and Teams, and Microsoft sends the confirmations and reminders.
  • BookingsXP adds an embeddable widget and hosted booking page, conversion tracking and attribution, an analytics dashboard, and, where your plan includes them, stored bookings, exports, webhooks, Microsoft Teams and Slack alerts, and a REST API.

BookingsXP is independent and is not affiliated with or endorsed by Microsoft. Microsoft, Microsoft 365, Microsoft Bookings, Outlook and Teams are trademarks of the Microsoft group of companies.

2. Your Microsoft 365 subscription

You are responsible for your own Microsoft 365 subscription and licences, and for your Microsoft Bookings configuration: services, staff, availability, booking rules, questions, notifications and publishing settings.

The Service depends on Microsoft's public Bookings pages. Microsoft may change, limit or interrupt those pages at any time, and when it does, the widget may not work as expected until we adapt. We will make reasonable efforts to keep up with such changes, but we are not responsible for Microsoft's services or for changes Microsoft makes.

Shared Bookings pages are fully supported. Personal "Bookings with me" pages are supported on a best-effort basis.

3. Accounts

  • You must give accurate information when you sign up and keep it up to date.
  • You are responsible for your account, for keeping sign-in details and API keys secret, and for what happens under your account, including the actions of team members you invite.
  • Tell us promptly at hello@bookingsxp.com if you believe your account or an API key has been compromised.
  • You must be at least 18 and using the Service for business or professional purposes.

4. Plans, billing and trial

  • Plans. The Free plan costs $0, needs no card and includes one widget. Pro costs $19 a month or $190 a year and includes five widgets. Business costs $49 a month or $490 a year and includes 50 widgets. What each plan includes is set out on our pricing page at the time you subscribe.
  • Trial. Pro comes with a one-time 14-day trial that does not need a card. At the end of the trial, your account moves to the Free plan unless you choose a paid plan.
  • Prices and tax. Prices are in US dollars and exclude taxes. Applicable taxes are added at checkout.
  • Payments. Payments are processed by Dodo Payments, which acts as merchant of record and is the seller on your invoice. Its terms apply to the payment itself.
  • Renewal. Paid plans renew automatically at the end of each monthly or yearly period until you cancel.
  • Cancellation. You can cancel any time from the dashboard. Your plan stays active until the end of the period you have paid for and then moves to Free. We do not refund partial periods unless the law requires it.
  • Downgrades and limits. If you move to a plan with lower limits, widgets and features above the new limits may be switched off, and stored data older than the new plan's retention period will be deleted by the normal retention process.
  • Price changes. We may change prices for future periods. We will tell you at least 30 days in advance, and the change applies from your next renewal after that notice.

5. Acceptable use

You must not use the Service to:

  • break any law, including data protection, consumer protection, anti-spam and advertising laws;
  • embed a widget for a Microsoft Bookings page you are not authorised to use;
  • collect personal data from visitors without the notices and permissions the law requires;
  • send malware, spam or unlawful content, or collect bookings for unlawful services;
  • probe, scan or test the Service's security without permission, except under the responsible disclosure process on our Security page;
  • overload, disrupt or reverse engineer the Service, get around rate limits or plan limits, or access it by automated means other than the documented API;
  • resell or provide the Service to third parties, except that agencies may set up and manage widgets for their own clients.

We may suspend a widget or an account that breaks these rules or puts the Service or others at risk. Where it is reasonable to do so, we will tell you first and give you a chance to fix the problem.

6. Your data and our processing of it

Your content. You own your account data, widget settings and any booking data the Service handles for you ("Customer Data"). You give us permission to host, process and transmit Customer Data only as needed to provide the Service, to keep it secure and to meet our legal obligations.

Your responsibilities as controller. For your visitors' personal data, you are the controller and BookingsXP is your processor. You are responsible for having a lawful basis for the processing, for your website's privacy notice and any consent banner, and for the tracking tools you connect (such as Google Analytics, Google Ads, Meta and LinkedIn), which run under your own accounts and terms.

Our commitments as processor. When we process your visitors' personal data, we will:

  • process it only on your documented instructions, which are these Terms and the settings you choose in the dashboard, unless the law requires otherwise;
  • make sure the people who process it are bound by confidentiality;
  • protect it with appropriate technical and organisational measures, including encryption in transit, hashed API keys and signed webhooks;
  • use only the subprocessors listed on our Security page and in our Privacy Policy, stay responsible for them, and keep that list current;
  • help you respond to data-subject requests, including through the erase-by-email tool in the dashboard;
  • tell you without undue delay if we become aware of a personal data breach affecting your Customer Data;
  • delete stored bookings and analytics at the end of your plan's retention period (Free 30 days, Pro 12 months, Business 24 months), and delete Customer Data within a reasonable period after your account closes, unless the law requires us to keep it;
  • give you the information reasonably needed to show that we meet these commitments.

Store bookings. Storing a copy of each booking (name, email, phone, notes, answers and attribution) is off by default and is switched on per widget by you. If you do not switch it on, BookingsXP does not keep your visitors' names or emails, only anonymous funnel counts.

Aggregated data. We may use anonymous, aggregated information about how the Service is used, which does not identify you or any individual, to run and improve the Service.

7. Intellectual property

We own the Service, including the software, widget templates, designs, documentation and the BookingsXP name and marks. We give you a non-exclusive, non-transferable right to use the Service, and to embed the widget on websites you control, while your account is active and in line with these Terms.

If you send us feedback or suggestions, we may use them without any obligation to you.

The Free plan shows a "Powered by BookingsXP" badge in the widget. You must not remove or hide it except by moving to a plan that removes it.

8. Availability and changes to the Service

We work to keep the Service available, but we do not promise that it will be uninterrupted or error-free, and we do not offer a service level agreement. We may change, improve or remove features. If we remove a material feature of a paid plan during a period you have paid for, we will tell you in advance, and you may cancel and receive a pro-rata refund for the unused part of that period.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not guarantee that every booking, event or conversion will be recorded or reported by Microsoft, Google, Meta, LinkedIn or any other third party, or that ad platforms will attribute conversions in any particular way. Analytics and attribution depend on visitors' browsers, privacy settings and third-party services, and are not a complete record of every visit.

Nothing in these Terms limits rights you have under consumer or other laws that cannot be excluded.

10. Limitation of liability

To the fullest extent the law allows:

  • neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, bookings, goodwill or data, even if told they were possible;
  • each party's total liability arising out of or relating to these Terms in any 12-month period is limited to the greater of the amount you paid us for the Service in that 12-month period and US$100.

These limits do not apply to your payment obligations, to either party's liability for fraud, or to any liability that cannot be limited by law.

11. Indemnity

You will defend and indemnify BookingsXP against claims by third parties that arise from your Customer Data, your use of the Service in breach of these Terms or the law, or your Microsoft Bookings configuration.

12. Suspension and termination

You can stop using the Service and close your account at any time.

We may suspend or terminate your account if you materially breach these Terms and do not fix the breach within 14 days of our notice, if you fail to pay, or immediately if needed to prevent harm to the Service, to others or to comply with the law.

When your account closes, your right to use the Service ends, widgets stop loading, and we delete Customer Data within a reasonable period as described in section 6 and our Privacy Policy. Export anything you need, such as a CSV of stored bookings on plans that include it, before you close your account. Bookings already made remain in your Microsoft Bookings.

Sections that by their nature should survive termination, including sections 6, 7, 9, 10, 11 and 14, survive it.

13. Changes to these Terms

We may update these Terms. We will change the date at the top and, for material changes, tell account holders by email or in the dashboard at least 30 days before the change takes effect. If you keep using the Service after that, the updated Terms apply. If you do not agree, you can cancel before the change takes effect.

14. Governing law

These Terms are governed by the laws of India. The courts at Gurugram, Haryana have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek urgent injunctive relief in any competent court.

15. General

These Terms, together with the Privacy Policy and the plan you choose, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. A failure to enforce a right is not a waiver of it. You may not transfer your account without our consent; we may transfer these Terms as part of a sale or reorganisation of the Service. Neither party is responsible for delays caused by events beyond its reasonable control.
